Defense Verdict in MMPA Case

January 8, 2024

Corey Kraushaar and Remington Harris received a complete defense jury verdict for their client after a three-day trial. Plaintiff claimed that his vehicle was severely damaged during defendant’s auto body repair service, including cutting through a quarter panel that remained unsecure, using unapproved recycled parts, and leaving metal shavings in the passenger airbag. Plaintiff further claimed that defendant misrepresented and concealed those items and did not repair the vehicle to a pre-collision condition. The Court allowed plaintiff to submit both his Missouri Merchandising Practices Act claim and breach of contract claim. Plaintiff requested $13,000 in actual damages and $250,000 in punitive damages. The jury rejected all claims and awarded no damages.
