Favorable Verdict in Road Rage Case

Corey Kraushaar and Jim Smart received a favorable verdict for their client after a three-day jury trial in St. Louis County for a motor vehicle accident case. Plaintiff claimed that defendant acted out of road rage, striking her vehicle multiple times while blacking out. Plaintiff suffered a full rotator cuff tear in her shoulder requiring surgeries and the need for a future shoulder replacement. Defendant had a prior medical episode requiring hospitalization less than two months before the accident in question. Plaintiff argued that defendant had notice of his medical condition based on the prior episode, and it was foreseeable that he could cause an accident by blacking out. Plaintiff requested $900,000 in damages from the jury. The jury returned a verdict for $250,000.
